This Privacy Policy explains what personal data CloudByteX Inc. collects through this website, how we use and protect it, and the rights you have over it.
1. Who we are
CloudByteX Inc. (“CloudByteX”, “we”, “us”) operates this website and is the personal information controller for the data described here. We comply with the Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, and the issuances of the National Privacy Commission (NPC).
2. Information we collect
Information you give us
When you send the contact form, we collect:
- your full name and work email address;
- your company name, if you provide it; and
- the services you are interested in and any message you write.
Please do not include sensitive personal information, such as health details or government ID numbers, in your message.
Information collected automatically
- Hosting and security logs. Our hosting provider, Cloudflare, processes your IP address and basic request details to deliver each page and to protect the website from attacks.
- Visit statistics. Cloudflare Web Analytics counts visits without cookies and without identifying you. It records the page you opened, the site that referred you, your country, and your device and browser type.
3. How we use your information
- To reply to your request and schedule your free audit.
- To prepare a proposal, plan or quote for you.
- To keep a record of our communication with you.
- To operate, secure and improve this website.
- To comply with our legal obligations.
We do not sell personal data, and we do not use it for advertising or automated decision-making.
4. Legal basis for processing
Under Section 12 of RA 10173, we process your personal data on the basis of your consent, which you give when you send the form; our legitimate interest in responding to business inquiries and keeping this website secure; and, if you become a client, the performance of our contract with you.
5. Cookies and similar technologies
This website does not use cookies or advertising trackers. If you choose to pause the animations, your browser stores that choice on your own device. It is never sent to us.
6. How we share information
We share personal data only with:
- the CloudByteX team members who handle your request;
- service providers that host our website and email, who process data only on our instructions and under confidentiality and security obligations; and
- government authorities, when the law requires it.
If CloudByteX is involved in a merger, acquisition or sale of assets, personal data may be transferred under the same protections described in this policy.
7. International data transfers
Our hosting provider runs a global network, so your data may be processed outside the Philippines. When that happens, we make sure it remains protected to the standard required by RA 10173.
8. How long we keep your information
We keep contact form requests for up to 12 months after our last communication with you. If you become a client, we keep the related records for as long as our contract and the law require. After that, we securely delete the data or anonymize it.
9. How we protect your information
- All pages and form submissions are sent over encrypted connections (HTTPS).
- Access to personal data is limited to the team members who need it.
- Our staff are bound by non-disclosure agreements.
If a personal data breach puts your rights at risk, we will notify you and the National Privacy Commission within 72 hours of discovering it, as the law requires.
10. Your rights
Under RA 10173, you have the right to:
- be informed about how your personal data is processed;
- access your personal data and obtain a copy of it;
- object to processing, or withdraw your consent at any time;
- correct inaccurate or incomplete data;
- have your data blocked, removed or destroyed;
- data portability;
- be indemnified for damages caused by inaccurate, incomplete or unlawfully processed data; and
- file a complaint with the National Privacy Commission at privacy.gov.ph.
